Creditors' Rights, Workouts, Restructuring and Bankruptcy

We have a diversified creditors' rights, workout, restructuring and bankruptcy practice. We regularly represent financial institutions, including single creditors, agents and participants in lending syndicates, indenture trustees, investment banks, hedge funds, and private equity funds, in out-of-court restructurings and workouts and in bankruptcy proceedings. We represent unsecured, and secured, including asset-based, lenders in structuring and documenting out-of-court restructurings.

We also represent indenture trustees and institutional bondholders in connection with agreements to restructure corporate debt outside of bankruptcy by various means such as consent solicitations and in bankruptcy through pre-packaged or pre-negotiated bankruptcy plans.

We handle cases involving a wide diversity of special industries, including real estate, retailing, professional services, communications, media, apparel, gaming, oil and gas, airlines and utilities. We also have extensive experience in negotiating cash collateral stipulations and debtor-in-possession financing agreements. We represent creditors in connection with the drafting of plans of reorganization and post-confirmation trusts established to implement provisions of confirmed plans.  The firm routinely advises creditors serving as members of creditors' committees in many national and regional bankruptcy cases.
