Mr. Bialo's practice focuses on the counseling of and litigation and arbitration for petroleum, banking, and industrial companies with respect to a wide variety of adverse claims and potential liabilities.

Representative Matters

  • Successfully defended an indenture trustee against claims by bondholder for breach of duty for alleged failure to extract issues from annual report.
  • Successfully defended an international petroleum company against claims of breach of contract, fraud and RICO violations brought by disappointed royalty owner.
  • Successfully defended a beverage company against claims of breach of contract and antitrust violations brought by the world's largest soft drink maker.
  • Successfully defended a radio station owner against claims made by a rival broadcaster for breach of contract to sell AM station.
  • Successfully defended an intermediary bank against claims of wrongful block of wire transfers sent from the Middle East.
  • Successfully defended a secondary issuer against claims of securities fraud made on behalf of putative class.

Professional Activities

Mr. Bialo is a member of the American and New York State Bar Associations and of the Association of the Bar of the City of New York, and has served on various committees of each, including as Chair of the Corporate Counsel Committee of the Federal Litigation section of the NYSBA.

Mr. Bialo has written and lectured on antitrust class actions, expert testimony under the Daubert rule, and successful settlement negotiation techniques.

He is presently Vice-Chair of the New York State Municipal Bond Bank Agency and the New York State Tobacco Settlement Finance Corporation.



Community Involvement

Mr. Bialo has been Trustee and Mayor of the Village of Larchmont, New York.  He serves as Director of Furniture Sharehouse, Inc., Westchester County's furniture bank.  Mr. Bialo also co-hosts a radio program on WVOX, 1460 AM.
